These Terms of Service ("Terms") constitute a legally binding agreement between Nouriq Wellness Private Limited ("Nouriq", the "Company", "we", "us", or "our") and any individual who accesses or uses our website, mobile application, smart bottle hardware, nutraceutical consumables, or related services ("you" or "user").

These Terms govern your access to and use of the Nouriq ecosystem, which includes:

• (a) the Nouriq website located at www.nouriqwellness.com (the "Website");
• (b) the Nouriq mobile application (the "App");
• (c) the Nouriq Fizz smart water bottle and its associated firmware (the "Device");
• (d) nutraceutical consumables designed for use with the Device (the "Consumables");
• (e) digital metrics, insights, notifications, analytics, and other data features (the "Insights"); and
• (f) any other content, products, or services made available by Nouriq

(collectively, the "Services").

Your use of the Services indicates that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.

1. Nature of Services & Wellness Disclaimer

Nouriq is a wellness-focused technology platform designed to support hydration and daily performance through a combination of smart hardware, nutraceutical consumables, and digital insights. The Services are intended solely for general wellness and lifestyle support. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. No information provided through the Services should be interpreted as medical advice. Users with medical conditions, allergies, dietary restrictions, or who are pregnant, nursing, or under medication should consult a qualified healthcare professional before using the Services or consuming any nutraceutical products.

2. Eligibility & User Responsibilities

By using the Services, you confirm that you are at least eighteen (18) years of age and legally capable of entering into binding agreements. You agree to use the Services responsibly and in compliance with applicable laws, product instructions, and safety guidelines. Any misuse, unauthorized modification, tampering, reverse engineering, or commercial exploitation of the Nouriq hardware, consumables, formulations, software, or intellectual property is strictly prohibited.

3. Account Creation, App Use & Connectivity

Certain features of the Services require account creation within the Nouriq mobile application and pairing with the smart bottle via Bluetooth or similar connectivity. Users may be required to enable device permissions for Bluetooth, notifications, camera, storage, or background syncing. We do not guarantee uninterrupted connectivity, compatibility with all devices, or continuous operation, as performance may depend on device model, operating system, environmental conditions, and user behaviour. Users are responsible for maintaining updated devices, firmware, and software to ensure optimal operation.

4. Nutraceutical Consumables & Safety

Nouriq nutraceutical consumables are formulated for adult consumption and must be used strictly as directed. Users agree to store consumables properly, avoid consumption past the expiry date, and refrain from using non-Nouriq consumables with the smart bottle. Ingestible nutraceutical products are not intended to replace a varied and balanced diet. For hygiene and safety reasons, consumables that have been opened, unsealed, or partially used are not eligible for return under Indian retail and consumer safety regulations. Consumables are not covered under hardware warranty.

5. Online Store & E-Commerce Terms

When purchasing products through the Nouriq website or app, users agree to provide accurate and complete billing, payment, and shipping information and to update such information as necessary. Nouriq reserves the right to verify orders, limit quantities, reject transactions, or cancel orders suspected of fraud, resale, bulk purchasing, or misuse. Product prices, specifications, and availability are subject to change without prior notice. All purchases are subject to Nouriq's separate Return & Refund Policy.

6. Accuracy, Completeness and Timeliness of Information

We are not responsible if any information made available through our website, mobile application, smart bottle hardware, nutraceutical consumables, or related services is not accurate, complete, or current. All such material is provided for general informational purposes only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on such material is at your own risk.

Our website, mobile application, smart bottle hardware, nutraceutical consumables, and related services may also contain certain historical information. Historical information, by its nature, is not current and is provided for reference purposes only. We reserve the right to modify the content at any time, but we have no obligation to update any information. You agree that it is your responsibility to monitor changes to our Services.

7. Digital Insights & Data Interpretation

The Nouriq app may enable nutraceutical dispensing, track nutrient intake, supplementation frequency, and provide reminders to help users build healthier wellness habits over time. These insights are informational and motivational only and are not intended as clinical evaluation, diagnosis, or treatment advice. Accuracy may vary based on sensor performance, user inputs, environmental conditions, and usage patterns. Nouriq does not warrant that displayed data represents medical, nutritional, physiological, or diagnostic accuracy.

8. Future Subscription Programs

Nouriq may, in the future, offer optional subscription or auto-replenishment programs for consumables or digital features. Additional terms, including billing, cancellation, renewal, RBI recurring payment compliance, and refund rules, will apply at the time such subscription programs are made available. Your participation in such programs will be optional and governed by supplemental terms.

9. Intellectual Property

All software, algorithms, designs, formulations, trademarks, trade names, product names, bottle designs, UI/UX elements, and proprietary content are the exclusive property of Nouriq Wellness Private Limited. Unauthorized duplication, distribution, resale, modification, or derivative use may result in civil or criminal liability. No rights are granted to users except as expressly permitted under these Terms.

NOURIQ is registered trademark, owned by Nouriq Wellness Private Limited, and represents a valuable asset. Any improper use of Nouriq products or unauthorized use of trademark for commercial purpose, regardless of the channel and media, will be deemed as infringement and enforced.

10. Termination

Nouriq may suspend or terminate user access at its sole discretion for violation of these Terms, misuse of Services, fraudulent activity, or actions that may harm the Company or other users. Obligations incurred prior to termination shall survive termination.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Nouriq disclaims liability for indirect, incidental, punitive, special, or consequential damages, including without limitation loss of revenue, profits, data, goodwill, use of product, or business interruption arising from or related to the use or inability to use the Services. In all cases, Nouriq's maximum aggregate liability shall not exceed the amount actually paid by the user for the specific product or service giving rise to the claim. These limitations apply whether claims are based in contract, tort, negligence, strict liability, or otherwise.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nouriq Wellness Private Limited, its directors, officers, employees, agents, affiliates, suppliers, and partners from claims, damages, liabilities, losses, and expenses (including legal fees) arising out of: (a) your misuse of the Services, (b) your violation of these Terms, (c) your violation of applicable laws or regulations, or (d) your infringement of any third-party rights.

13. Warranty Terms (Hardware Only)

Nouriq smart bottle hardware may include a limited warranty provided separately. Warranty coverage excludes consumables, cosmetic damage, wear and tear, unauthorized repairs, use with non-Nouriq products, misuse, accidents, and environmental damage. Users must retain proof of purchase for warranty support. Consumables are not covered under warranty.

14. Returns & Refunds

Returns, refunds, or replacements are governed by Nouriq's Return & Refund Policy. For safety and regulatory reasons, nutraceutical consumables that are opened, unsealed, or partially consumed cannot be returned. Hardware returns may be accepted subject to inspection and policy criteria.

15. Privacy & Personal Data

Personal data submitted through the Services is governed by Nouriq's Privacy Policy, which outlines data collection, use, storage, and sharing in accordance with Indian data protection and IT regulations.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remainder of the Terms shall remain enforceable.

18. Entire Agreement

These Terms, together with the Privacy Policy and applicable purchase policies, constitute the entire agreement between the parties and supersede all prior or contemporaneous communications, agreements, or understandings relating to the Services.

19. Modification of Terms

Nouriq reserves the right to update or modify these Terms at its sole discretion by posting revised Terms on the Nouriq website or app. Continued use of the Services following such changes constitutes acceptance of the revised Terms.
